Land measuring 1954 Kanal for AIIMS Jammu not “Gair Mumkin Khad” ?: Which law allows construction?

JAMMU, Oct 13 (Agencies): It is well aware of the fact that thousand of innocents of J&K are being harassed by JKUT administration as a whole on undesired issue of” Gair Mumkin Khad Lands” for not allowing constructions/sale/purchase but there is no Govt Order issued by any authority till day, speaks of super power of bosses over innocents & proved case of harassment in J&K?
It is to mention here that there was ban during the year 2014 to 31st October, 2017 due to DB’s orders in a WPPIL & CWPPIL, but chapter of confusions closed on 31st Oct 2017 after issuance of SRO-456 of 2017 dtd 25th October 2017.
Strange to mention here that Div Com/DCs were designated as adjudicating Officers to decide the confusions on Khad Lands but they did nothing causing harassment to innocents & otherside loss to Govt to crores per month by way of STAMP DUTY FEE.
Thereafter, once upon a time Administrative Council headed by LG Manoj Sinha passed a time bound Decision vide No 17/1/200 dtd 29th Jan 2022, which was followed by G.O.No 18-JK(Rev) of 2022 dtd 4th Feb 2022, directed DCs to complete the excercise on Khad Lands in 03 months but started the said order by quoting SRO-456 of 2017 dtd 25th October, 2017 but today 19 months have lapsed & results & non compliance of LG/Govt by DCs is proved on ground.
Pertinent to mention here that recently CS, Dr Arun Mehta also in CoS meeting of 25th July 2023 directed the Revenue Officer to complete the said excercise in one month but …
Above all it is mention here that Jammu Master Plan 2032 has clearly mention of Buffer Zones & Water Bodies & fixed no construction zone nearby such River/ Canal/ khads & which superceeds all Revenue Laws in Master Plan Areas but interference of Revenue Dept in Master Plan areas & sleeping of Pr Secretary H&UDD raised a big question on both departments.
However, everybody know AIIMS Vijaypur is being constructed in open Khad area but has been allowed with biggest ever construction in J&K but small houses in thickly populated areas like Roop Nagar, Grater Kailash, Sainik Colony, Deeli, Bhalwal, Meen Charkan etc etc have been restrained by showing illegal super powers in open violation of Art 14 & 16 of Constitution of India.
